David Fair
The name David Fair is synonymous with Dallas real estate. A member of the respected Broker/Lawyer committee for many years, Fair's legal phrases can be found in almost every contract form in Texas. He is regularly called upon to draft phrases or entire contracts for today's complicated transactions. In addition, Fair formed FW Exchange Corporation, as a related entity to Hexter-Fair Title Company, to serve as a "Qualified Intermediary" for IRS Section 1031 Tax-Deferred Exchanges. David Fair has participated in some of Dallas' most interesting real estate transactions, and has been privy to some of Dallas' best-kept real estate secrets. Fair was in the original group of five persons who planned and implemented the confidential "blocking" of more than 1000 separate parcels of real estate that now comprise the CityPlace area of Dallas. Fair drafted the "air rights" acquisition by several developers from the City of Dallas to construct some of downtown Dallas' pedestrian sky bridges. Fair has served as a real estate advisor to many well known companies and their principals, and has served in different capacities for Governors William P. Clements, and Mark White. Fair was also actively involved in some of the landmark cases in the Texas judicial system, including the case that required "independent contract consideration" (i.e., an option fee) to be paid for feasibility studies in real estate contracts. Fair currently makes approximately 150 speeches a year to real estate industry groups, discussing current legal problems facing industry members, or providing business forecasts for real estate firms and mortgage lenders. Fair's regular educational program entitled "Ask Your Lawyer" has become a regular event for most of the Realtors in the four county area. A native Dallasite, Fair has built lasting relationships with Dallas' best real estate companies and law firms. In fact, Fair says that, after all these years, his work has almost become his hobby.
